These Terms of Service ("Terms") govern your access to and use of SmarterView's software-as-a-service (SaaS) platform, website, and related services (collectively, "Services"). 2. Definitions
- "SmarterView," "we," "our," "us" – Refers to SmarterView Pty Ltd, an Australian company providing SaaS solutions.
- "User," "you," "your" – Refers to any individual or entity using our Services.
- "Subscription" – A paid plan granting access to our platform.
3. Eligibility & Account Registration
- You must be at least 18 years old and capable of forming a binding contract under Australian law to use our Services.
- You are responsible for maintaining the security of your account and keeping login credentials confidential.
- SmarterView is not liable for any unauthorised access resulting from your failure to protect your credentials.
4. Subscription & Payment Terms
- Access to SmarterView requires a paid subscription based on the selected plan.
- All payments are processed securely through third-party providers. We do not store payment information.
- Subscription fees are billed monthly or annually as per the selected plan.
- No refunds are provided for unused subscription periods unless required by Australian Consumer Law.
5. Acceptable Use
By using SmarterView, you agree NOT to:
- Use our Services for any unlawful or fraudulent activities.
- Copy, modify, distribute, or reverse-engineer any part of our platform.
- Interfere with the operation of our Services or attempt to gain unauthorised access.
- Upload or share any harmful, offensive, or illegal content.
We reserve the right to suspend or terminate accounts violating these Terms.
6. Data Ownership & Privacy
- You retain ownership of the data you input into SmarterView.
- By using our Services, you grant us a limited license to process your data solely for providing and improving our Services.
- We handle all data in accordance with our Privacy Policy.
7. Service Availability & Support
We aim to provide reliable and uninterrupted access to our Services but do not guarantee 100% uptime. We may perform maintenance or updates, which may result in temporary disruptions.

8. Intellectual Property
- SmarterView and its associated trademarks, software, and content are owned by SmarterView Pty Ltd.
- You may not use our intellectual property without prior written consent.
9. Termination & Suspension

- You fail to make required payments.
- Your account is inactive for an extended period.
10. Limitation of Liability
SmarterView is provided "as is" without warranties of any kind.
To the extent permitted by Australian law, we are not liable for indirect, incidental, or consequential damages arising from your use of our Services.
11. Indemnification
You agree to indemnify and hold SmarterView harmless from any claims, damages, or expenses arising from your misuse of our Services or violation of these Terms.
12. Governing Law & Dispute Resolution
- These Terms are governed by the laws of Victoria, Australia.
- Any disputes will be resolved in Australian courts or through mediation where appropriate.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.
